Withdrawal of Delegation of Power given to the Chief Conservation Officer Regarding all Matters Dealing with Same Season Relief Well Capability

Pursuant to section 4.1 of the Canada Oil and Gas Operations Act (COGOA), the National Energy Board can and has delegated its powers under sections 5, 5.02, 5.11 and 5.12 of the COGOA to its Chief Conservation Officer (CCO).

The CCO and the Board are of the view that Same Season Relief Well (SSRW) capability in the Beaufort Sea is an issue of significant public concern. As such, the Board has decided on 13 August 2009 to withdraw its delegation of powers to the CCO insofar as these powers relate to decisions on matters that involve the consideration of SSRW capability in the Beaufort Sea. Any matter dealing with SSRW capability in the Beaufort Sea will, from now on, be directly handled by the Board.

SSRW capability matters may arise in the context of specific applications, and the Board will deal with those when they are filed. However, it may be that stakeholders would like to bring this SSRW capability matter to the attention of the Board in a more generic fashion. The Board wishes to convey that it would be amenable to the latter as well.

Should anyone have any matter dealing with SSRW capability in the Beaufort Sea that they wish to bring to the attention of the Board, such matters must be brought to the attention of its Acting Secretary, Ms. Anne-Marie Erickson.
