The purpose of this agenda is to provide information on the Board's activities. Except where otherwise noted, jurisdiction over the items in the agenda is exercised pursuant to the National Energy Board Act, R.S.C. 1985, c. N-7, as amended.

NEB Moves Forward
TransCanada Alberta System under federal jurisdiction
In June of 2008, TransCanada Pipelines Limited filed an application to the National Energy Board (NEB) requesting that the TransCanada Alberta System (also known as NOVA Gas Transmission Ltd.) be declared under federal jurisdiction.
A public hearing was held in November 2008 to respond to the application and on 26 February 2009, the NEB approved TransCanada's request for an order recognizing that the TransCanada Alberta System is under federal jurisdiction. On 15 April 2009, the NEB issued a certificate of public convenience under section 52 of the National Energy Board Act after having been granted approval by Governor in Council (GIC).
Federal regulation of the TransCanada Alberta System became effective on 29 April 2009.

Hearing Decisions Issued
1. TransCanada PipeLines Ltd. (TransCanada) - TransCanada Alberta System Application - GH-5-2008 (File OF-Fac-Gas-T211-2008-01 01)
On 17 June 2008, the NEB was asked to declare that the TransCanada Alberta System does indeed fall under federal jurisdiction and to issue a Certificate of Public Convenience and Necessity to that effect.
The Reasons for Decision were published on 26 February 2009.
2. Trans Québec & Maritimes Pipeline Inc. (TQM) - 2007 and 2008 Cost of Capital Application - RH-1-2008 (File OF-Tolls-Group1-T201-2007-03 01)
The application includes a request for the NEB to review its RH-2-94 Cost of Capital Decision released in March 1995, only as it applies to TQM. The NEB is also asked to issue an order approving an overall fair return on capital resulting from an ROE of 11.0 per cent applied to a deemed 40 per cent equity component of the company's capital structure. The calculation would also include TQM's actual cost of debt.
The Reasons for Decision were released on 19 March 2009.
3. SemCAMS Redwillow ULC (SemCAMS) - Redwillow Pipeline Project - GH-2-2008 (File OF-Fac-Gas-S393-2007-01 04)
SemCAMS is proposing to construct and operate a 149.7 kilometre, 323.9 millimeter pipeline to gather 30 per cent dehydrated sour gas from the Grizzly Valley area southwest of Tumbler Ridge, B.C. into existing Alberta regulated gathering and processing facilities. The application was filed on 7 December 2007.
The Reasons for Decision were released on 26 March 2009.
4. Yukon Pipelines Limited / Abandonment Order Review - MHW-R-1-2008 (File OF-Fac-Oil-Y016-1995-01 02)
This proceeding involved a written process which took place in October 2008.

Hearings in Progress
1. Imperial Oil Resources Ventures Limited (Imperial), Mackenzie Valley Aboriginal Pipeline Limited Partnership, ConocoPhillips (North) Limited, Shell Canada Limited and ExxonMobil Canada Properties - Proposed Mackenzie Gas Project - GH-1-2004 (Files 3200-J205-1, 2520-C-19-4, 2620-C-19-7, 2620-C-12-7 and 2620-C-20-7)
On 8 October 2004, the Board received applications for approval to construct and operate a natural gas pipeline and related facilities through the Mackenzie Valley in Canada's Northwest Territories to an interconnect point just south of the NWT/Alberta border. The 762 millimetre (30-inch) natural gas transmission pipeline would transport 34 million cubic metres (1.2 billion cubic feet) per day of natural gas from the Arctic to the south. The capital cost is estimated at over $16.2 billion.
2. Enbridge Pipelines Inc. (Enbridge) - Line 9 Tolls and Tariffs Application - RH-3-2008 (File OF-Tolls-Group1-E101-2007-04 01)
In this tolls and tariffs application filed by Enbridge Pipelines Inc. (Enbridge), the company was seeking approval for the toll principles as found in its Transportation Service Agreement and for the resulting tolls to be charged for transportation services on its only westbound Canadian crude pipeline.
A public hearing starting on 18 June 2008 was held in Calgary, Alberta.
New Facility Application
1. TransCanada Keystone Pipeline GP Ltd. (TransCanada) - Keystone XL Pipeline Application - OH-1-2009 (File OF-Fac-Oil-T241-2009-01 01)
Filed on 27 February 2009, the proposed project involves a crude oil line that would run from Alberta to markets in the Gulf Coast area of the United States (U.S.). The Canadian portion of the Keystone XL pipeline extends from Hardisty, Alberta to the Canada/U.S. border at Monchy, Saskatchewan. The Canadian portion would consist of constructing and operating approximately 525 kilometre (km) of pipeline and related facilities, including pump stations, tanks, and other related works and activities.
With an in service date of 2012, the pipeline would have an initial capacity of approximately 700,000 barrels per day and is designed to be expandable to 900,000 barrels per day.
The hearing is scheduled to start on September 15, 2009 at a location to be determined.

Included in the relief sought is a declaration that the NEB must ensure that the Crown has properly consulted with and accommodated affected First Nations. Trial date is set for 16 January 2009. The Decision is pending.

Online Application System
In an effort to improve regulatory effectiveness and efficiency, the National Energy Board (NEB) has developed a new Online Application System (OAS) for export and import applications. The OAS is designed to accept all short-term natural gas export and import applications, long-term natural gas in-transit order applications, short-term crude oil and/or refined petroleum product export applications, short term natural gas liquids export applications and blanket electricity export permit applications.
Currently, the NEB receives over 400 export and import applications each year. The new OAS ensures applicants submit all the information required to allow the NEB to process these applications as efficiently as possible. In addition, the OAS will improve the NEB's transparency to the public as all export applications and subsequent export authorizations will be posted in the Regulatory Document Index on the NEB's website.
