National Energy Board Pipeline Crossing Regulations Part I and Part II

The National Energy Board (the NEB or the Board) regulates more than 70 000 kilometres of pipelines throughout Canada under the authority provided to it within the National Energy Board Act. These pipelines operate continuously and safely delivering energy to satisfy the needs of Canadians and export markets.

Pipelines are often invisible. After their initial construction, all that may be left to indicate their presence are signs at fence lines and road crossings or clearings along the pipeline right of way.

The NEB believes that the safety and integrity of Canada's pipelines depend on public awareness and industry involvement. Activities which occur near pipelines and which have the potential to damage pipelines are regulated by the Board in the public interest. Currently, these activities are governed by the National Energy Board Pipeline Crossing Regulations.

PROPOSED DAMAGE PREVENTION REGULATIONS

In August 2010, the National Energy Board published the proposed Damage Prevention Regulations (DPR) in the Canada Gazette, Part I for a 30-day comment period. The Board thanks all stakeholders who submitted comments. In light of the comments received, the Board will not proceed with finalizing the proposed DPR at this time, pending further analysis and consultation with stakeholders. In November, the Board will draw from Members of the Land Matters Group to conduct a workshop to discuss concerns identified in recent submissions.

This will assist the Board in developing a plan to achieve regulatory clarity for its damage prevention framework by 29 February 2012, as communicated in its Action Plan for Safety and Environmental Protection.
